Governor Michelle Lujan Grisham signed the bill to legalize adult use, the Cannabis Regulation Act, on April 12, 2021. The Act legalized the cultivation, manufacturing, purchasing, possession, and consumption of recreational cannabis for adults 21 and older. Additionally, the Cannabis Regulation Act combined the regulation of both adult-use and medical cannabis into one commercial cannabis framework, administered by the Cannabis Control Division. The Department of Health continues to oversee the medical cannabis patient program.

The first licensed sales of recreational cannabis began on April 1, 2022. Even though adult-use cannabis is legal in New Mexico, there are laws regulating cannabis from seed to consumption.
